Immigrate to Canada - Constitutional and Charter Litigation

Our law firm has built a strong reputation for representing clients in difficult Constitutional, and Charter of Rights and Freedoms cases.

We have been involved with the following types of cases.

  1. Presenting Constitutional arguments to the Immigration Division, the Federal Court of Canada and the Federal Court of Appeal, over a 13 year period, for the trans-border crossing aboriginal rights of Canada's "first people's".
  2. Seeking the release from jail of Chinese women who were being detained in a provincial detention facility on the basis that the section 15 Charter equality rights of these women were being violated. These women were part of a group of migrants who arrived in several boat loads on the shores of Canada's west coast in the Summer of 1999.
  3. Making submissions before the Immigration Appeal Divison for the "aboriginal" Citizenship rights of an aboriginal person of Canada, who was not born in Canada. The case argument relied on the applicant's aboriginal rights "trumping" the immigration and citizenship laws of Canada.
  4. Engaging in focussed consultations and developing arguments to be made to the Federal Court of Canada for the section 15 equality rights of foreign born children adopted by Canadian Citizen parents, to be granted Canadian Citizenship upon being adopted.
